Employment Law Essay Free Online Research Papers The purpose of this report is to investigate an exact, theoretical employment situation encountered and to include the information regarding employment conflicts, questions, grievances, lawsuits, etc., in terms of how the situation was handled or resolved. Employment situations are a constant issue every day in any organization; it is how you handle them both legally and professionally that counts. Situation In this circumstance, an employee that is new to office politics was constantly making insulting and racial remarks. The remarks the employee was making were not deliberately insulting or racial, the employee did made the remarks ignorantly. The employee would make remarks such as ââ¬Å"well, all the people who live in that neighborhood are white and richâ⬠and ââ¬Å"old people should not drive. Anyone over the age of 50 should be restricted from driving. They always cut me off. Forget it if they are Asian, it doesnââ¬â¢t matter what their age is.â⬠These comments are against the diversity policy at the company the employee is employed. More than a few other employees had made other remarks in regards to comments made about African Americans and Asians from the employee. Several employees brought it to the attention of the employeeââ¬â¢s manager to address. Federal Employment Laws The employee is in violation of federal laws that protect employees regarding insulting or racially remarks. According to Title VII of the Civil Rights Act of 1964, it is illegal to harass someone because of the persons race or color, religion, sex, pregnancy, childbirth and national origin including membership in a Native American tribe (Cheeseman, 2007). The Civil Rights Act is not just for employers but employees as well. When the employee was confronted about the situation, they said that the person he said these things to was agreeing with him. The situation was brought to the employeeââ¬â¢s attention that it was not that particular employee that complained, rather a group of people who overheard this. Of course, this upset the employee stating that the other employees were eavesdropping and should not have been listening to his conversations. The manager had to remind the employee of the laws pertaining to harassment and that it did not matter if he had said it directly or i ndirectly to the offended employees. The Effectiveness of the Law The employee had received training in diversity and had completed a required tutorial on workplace harassment. The law is very clear in respect to workplace harassment and the employee was reprimanded appropriately. As he questioned his actions and what exactly he had done, the law provided very specific answers. When reminded of his tutorials, he abdicated that he had done wrong and accepted the consequences. Actions Required by Law Appropriate action is required by law. Once information is gathered it must be concluded as to whether or not some form of discrimination or harassment occurred. It is up to the company to decide how to punish the employee if a decision has been made for punishment. A discipline measure might be termination of the employee because in some cases of harassment and discrimination termination could be an option. Any employee can make a complaint to the Employment Opportunity Commission (EEOC) which would help with a discrimination case (Cheeseman, 2007). Contract Employees Contract employees working on behalf of the organization are as legally obligated to follow all employment laws and are as protected as full-time employees. If the contract employee was the offender, immediate dismissal could occur as long as it did not conflict with the contract between them and the organization. Most contracts have a clause which includes HR policies and procedures and what the contract employee is required or not required to do or to abide by. For example, a temporary employee is a contract employee. If they are harassed by a full-time employee, the temporary agency may act on their behalf and file a complaint against the employee and the organization. The same is true if the situation was reversed. If a contract or temporary employee violates employment laws, the organization may bring charges again the individual or the organization in which the contract employee is contracted from. The harasser can be the victims supervisor, manager, or coworker. An employer ma y even be liable for harassment by a nonemployee (such as a vendor or customer), depending on the circumstances (Findlaw.com, 2008). Unions According to San Francisco lawyer, Michael Mortimer (2006) labor law and employment law are not the same. Labor Law refers to state and federal laws related to organized labor, labor unions, union contracts, grievance procedures and a federal regulating body called the National Labor Relations Board (Cheeseman, 2007). Employment laws and labor laws are different. Employment laws usually only deal with matters that are nonunion. Many state and federal laws pertain equally to all unions (Mortimer, 2006). Conclusion In order to answer this question appropriately, the manager would have to consult the contract in which the employee or employees are under. As noted above, most union contracts have specifics in their contract related to discrimination and/or harassment; however, in this situation, most likely the employees would not have to go through the union to file a complaint against the offender; however, the offender would have certain protections in relation to his contract. Biography of Henri Rousseau, Self-Taught Post-Impressionist Henri Rousseau (May 21, 1844 ââ¬â September 2, 1910) was a French painter in the post-impressionist era. He started painting late in life and was roundly mocked in his own time, but was later recognized as a genius and became an influence on later avant-garde artists. His father was a tinsmith, and he had to work alongside his father from the time he was a young boy. As a youth, he attended the local Laval High School, where he was mediocre in some subjects but excelled in creative disciplines such as music and drawing, even winning awards. Eventually, his father went into debt and the family was forced to give up their house; at this time, Rousseau began boarding at the school full-time. After high school, Rousseau attempted to start a career in law. He worked for a lawyer and began his studies, but when he was involved in an incident of perjury, he had to abandon that career path. Instead, he enlisted in the army, serving four years from 1863 to 1867. In 1868, his father died, leaving Rousseau to support his widowed mother. He left the army, moved to Paris, and instead took up a government post, working as a toll and tax collector. Rousseau was known as Le Douanier (the Customs Officer) after his place of work. Essentially self-taught, Rousseaus naive primitive style of painting was widely ridiculed during his lifetime although he later came to be seen as an artist of considerable significance. Print Collectorà /à Getty Images That same year, Rousseau married his first wife, Clà ©mence Boitard. She was his landlordââ¬â¢s daughter and, being only fifteen years old, was nine years his junior. The couple had six children together, but only one survived, their daughter Julia Rousseau (born 1876). A few years into their marriage, in 1871, Rousseau took on a new post, collecting taxes on goods coming into Paris (a specific tax called the octroi). Early Exhibits Starting in 1886, Rousseau began exhibiting artwork in the Salon des Indà ©pendants, a Paris salon founded in 1884 that counted Georges Seurat among its founders. The salon was formed as a response to the rigidity of the government-sponsored Salon, which focused heavily on traditionalism and was less than welcoming to artistic innovations. This was a perfect fit for Rousseau, although his work was not displayed in places of prominence within the exhibitions. Rousseau was almost entirely self-taught, although he admitted to having received some ââ¬Å"adviceâ⬠from Fà ©lix Auguste Clà ©ment and Jean-Là ©on Gà ©rà ´me, a pair of painters from the Academic style. For the most part, though, his artwork came all from his own self-training. He painted nature scenes, as well as developing a particular take on the portrait landscape, in which he would paint a particular scene, then place a person in the foreground. His style lacked some of the polished technique of other artists of the time, leading to him being labeled as a ââ¬Å"naà ¯veâ⬠painter and often disdained by critics. Painting by Henri Rousseau. His art slowly began to grow a following, and in 1891, Tiger in a Tropical Storm (Surprised!) was exhibited and earned his first major review with serious praise from fellow artist Felix Vallotton. In 1893, Rousseau moved to a studio in the art-centric neighborhood of Montparnasse, where he would live for the rest of his life. Ongoing Career in Paris Rousseau formally retired from his government job in 1893, ahead of his fiftieth birthday, and devoted himself to his artistic pursuits. One of Rousseauââ¬â¢s most famous works, The Sleeping Gypsy, was first seen in 1897. The following year, Rousseau remarried, a decade after losing his first wife. His new wife, Josephine Noury, was, like him, on her second marriage- her first husband had died. The couple had no children, and Josephine died only four years later, in 1892. This one, titled The Hungry Lion Throws Itself on the Antelope, was exhibited once again at the Salon des Indà ©pendants. It was placed near works by a group of younger artists who were leaning more and more avant-garde; one of the future stars whose work was shown near Rousseauââ¬â¢s was Henri Matisse. In retrospect, the grouping was considered the first showing of Fauvism. The group, ââ¬Å"the Fauves,â⬠may have even gotten the inspiration for their name from his painting: the name ââ¬Å"les fauvesâ⬠is French for ââ¬Å"the wild beasts.â⬠Rousseauââ¬â¢s reputation continued to climb within the artistic community, although he never quite made it to the uppermost echelons. In 1907, however, he received a commission from Berthe, Comtesse de Delauney- the mother of fellow artist Robert Delauney- to paint a work that ended up being The Snake Charmer. His inspirations for the jungle scenes were not, contrary to rumors, from seeing Mexico during his time in the army; he never went to Mexico. The Snake Charmer, 1907. Artist: Rousseau. à Heritage Images / Getty Images In 1908, Pablo Picasso discovered one of Rousseauââ¬â¢s paintings being sold on the street. He was struck by the painting and immediately went to find and meet Rousseau. Delighted with the artist and the art, Picasso proceeded to throw a half-serious, half-parody banquet in Rousseauââ¬â¢s honor, called Le Banquet Rousseau. The evening featured many of the prominent figures in the creative community of the time, not for a glittering celebration, but more of a meeting of the creative minds with one another in celebration of their art. In hindsight, it was considered one of the most significant social events of its time. Declining Health and Legacy Rousseauââ¬â¢s final painting, The Dream, was exhibited in 1910 by the Salon des Indà ©pendants. That month, he suffered from an abscess on his leg, but ignored the inflammation until it became too far gone. He was not admitted to the hospital until August, and by then, his leg had become gangrenous. After having surgery for his leg, he developed a blood clot and died from it on September 2, 1910. Fine Artà /à Getty Images Despite being criticized during his life, Rousseauââ¬â¢s style was hugely influential on the next generation of avant-garde artists, such as Picasso, Fernand Leger, Max Beckmann, and the whole surrealist movement. Poets Wallace Stevens and Sylvia Plath also drew inspiration from Rousseauââ¬â¢s paintings, as did songwriter Joni Mitchell. In perhaps the most unexpected connection: one of Rousseauââ¬â¢s paintings inspired the visual world of the animated film Madagascar. His work continues to be displayed to this day, where it is studied and admired much more than it ever was during his own life. For example, most buildings have a lighting system, a heating system and internal devices such as microwaves, televisions and computers. Linking some of these systems to each other would have many benefits including the increase of energy efficiency. There are many different examples of the ways in which systems could interact with one another in order to provide a more energy efficient environment. One example of this would be linking the heating system to internal and external environmental sensors so that the base heating level of the structure is able to be adjusted according to the temperature outside. This would mean that the house would be cooled on hot days, and warmed on cooler days. The result of this would be that the structure would be kept at a relatively constant temperature regardless of other factors. The concept of an intelligent home is one of the end products of such a system. Currently, the level of technology would this a very expensive proceeding, but nevertheless this has been demonstrated on a small scale. An intelligent home is one where the owner can control all activities from a single point, such as turning on or off lights using a remote control, or adjusting the house wide temperature. However, the most important factor of a intelligent home is that it can make use of the knowledge that it receives from a wide range of sources to do many mundane activities that are part of general housekeeping. When I was younger, cooking came intrinsically with the holiday season, which made that time of year the prime occasion for me to unite with ounces and ounces of satin dark chocolate, various other messy and gooey ingredients, numerous cooking utensils, and the assistance of my mother to cook what would soon be an edible masterpiece. The most memorable of the holiday works of art were our Chocolate Crinkle Cookies, which my mother and I first made when I was about six and are now made annually. I remember the deceitful character of the recipe the most from the first time I made Chocolate Crinkles. Being young, I didnââ¬â¢t understand the nature of unsweetened chocolate; it looked and smelled just like any other chocolate...

Freudian Allegory Lord of the Flies Essay
The way a person behaves can be analyzed by psychoanalysis showing that there is a structural model of personality; this model was created by Freud. There are three parts of personality: Id which contains primitive instincts, Superego which contains the conscience and Ego which maintains a balance. The Id is based on the principle of self pleasure and has no regard for the consequence their actions may have on others. The Superego is very moral and in control of what is right and what is wrong. The Ego is based on the principle of reality and is able to have needs and desires but also considers others in their decisions. In the novel, The Lord of the Flies by William Golding, these parts of the personality are represented by the three main characters and it shows that the contrast in their personalities and the lack of an authoritative ego leads to the breakdown of civilization. Jack, Ralph, and Piggy all represent this Freudian model and it is the conflict between these behaviors that causes the breakdown. The part of the personality known as the Id is represented primarily by Jack. This part of the personality allows for the basic needs of a person to be met but all actions are very primitive and are not morally correct. Jack is focused on instant gratification and does not seem to be very concerned about long term survival or being rescued. Superego, another part of the personality, is represented by Piggy. This part represents the conscience and the moral part of all human beings. Piggy is usually able to remind some of the boys what is right and what is wrong. The final part of the personality is known as the Ego and is considered to be the balance between the other two boys. Ralph is the representation of the Ego in this novel. This part of the personality understands that being impulsive can inevitably be harmful. Ralph sees the reality of the situation that they are in but is also able to think on a realistic level to try and meet the needs of the boys. Since he is the Ego, he is able to gain control over the boys and he makes his stance known when he says ââ¬Å"Weââ¬â¢ve got to have rules and obey them. After all, weââ¬â¢re not savagesâ⬠(Golding 46). Like the Ego, Ralph thinks realistically and wants everyone to think before they act so no rash actions occur and their chance of surviving and being rescued is higher. Ralph gains control of the boys on the island in the beginning of the novel, because of this he is made responsible for dealing with their survival and well being. One of the main things that he cares about for their survival is the building of shelters and he makes this clear when he says ââ¬Å"If it rains like when we dropped in weââ¬â¢ll need shelters all rightâ⬠(52). Ralph would like to swim and hunt but he knows that building a shelter would be more beneficial to their survival. He also says that the fire is the most important thing on the island (80) and doesnââ¬â¢t believe that they can be rescued by luck if they do not keep the fire going . The fire is also a symbol of how the boys were still civilized. As the fire starts to go out, the boys become less civilized and start to become more primitive, like the Id personality type. Ralph begins to lose his power as he and all the other boys start to become more irrational. Even though Ralph is the representation of t he Ego, he allowed the Id personality to take over him, ââ¬Å"The desire to squeeze and hurt was over-masteringâ⬠(116), when he attacked Simon. When Ralph begins to lose his control, Jack becomes the leader of they boys. With the Id being in control, there is no authoritative ego and the civilization on the island begins to break down. Jack is only concerned about power and instant gratification; he doesnââ¬â¢t feel anything for other people and feels only a need to hunt and nothing else. He causes constant disorder on the island by tempting the rest of the boys with the lure of meat and hunting while throwing survival and the chance of being rescued aside. His desire for power is overwhelming and he has no accord for Ralphââ¬â¢s authority. When Piggy is killed, Jack says to Ralph ââ¬Å"Thatââ¬â¢s what youââ¬â¢ll get! I meant that! There isnââ¬â¢t a tribe for you anymore! The conch is gone-â⬠(181). He feels nothing when Piggy is he killed and would do anything for the power he obtains. Once the conch is destroyed and the boys begin to become uncivilized, the Id becomes the prominent personality type. Piggy tries to stand up for the rules that he was taught to believe in and to the Id as the Superego. Piggy sees the conch as order on the island and believes it should be respected, he shows this when he says ââ¬Å"I got the conchâ⬠¦You let me speakâ⬠(42). When the boys let the fire go out of control, he makes an effort to tell everyone that they were wrong for letting that happen and that they also let one of the littleââ¬â¢ uns get away. He constantly challenges the Id and tries to stand up for what he believes to be right. The balance between his ideas and Jackââ¬â¢s also helped to keep the island stable but when Piggy was killed, the Id becomes dominant and the boys begin to lose control. With Ralph being the balance between Jack and Piggy, he is identified as the leader when the boys first arrive on the island but as time passes the boys begin to become more uncivilized. The lack of a real authoritative figure or an adult figure causes the boys to lean more towards the Id. When this happens, the boys begin to follow Jack because he offers instant gratification in the form of hunting and meat. Jack seems to be able to do anything for his power. Jackââ¬â¢s resistance to morals and control lead to Piggyââ¬â¢s death and the destruction of the conch. When Piggy dies, there no longer is a Superego on the island and the balance between them is broken. Ralph is not dominant enough as an Ego to keep the island civilized. This allows Jack and the Id to take control of the boys and the island, and this causes the breakdown of civilization.
